Copyright issues with making tshirts with a copyrighted logo on them?

My uncle makes T-shirts and he wants to give me a gift with a university logo on it along with another design. If he does not sell the shirt to me and gives it to me as a gift, and the logo is hand drawn, but looks exactly like the original copyrighted logo, is that legal if he does not have a license to sell the copyright? Remember he would be giving it as a gift because I would not be paying him for it... Thanks!!

Answer 2

I don't think there would be an issue with that. As long as he isn't making a profit from it I don't think it's illegal.

"My uncle makes T-shirts and he wants to give me a gift with a university logo on it along with another design. If he does not sell the shirt to me and gives it to me as a gift, and the logo is hand drawn, but looks exactly like the original copyrighted logo, is that legal if he does not have a license to sell the copyright?": What he wants to do is Illegal. "Remember he would be giving it as a gift because I would not be paying him for it..." it does not matter if it is a gift or not. he is violating copyright laws. The reason he is doing it does not matter, its the fact that he is doing it that is against the law.

Answer 4

Regardless of whether he gifts it or sells it, making a copy or derivative work of a copyrighted design is a copyright infringement, unless his use qualifies under one or more statutory exemptions (e.g., for use by a teacher or student for instruction in a classroom regarding how to make a screen print of a logo). He could be sued if anyone discovers what he has done, e.g., you wear it in public. You could also be sued if you wear it in public, which is a "public performance" of an unauthorized copy. If he were to sell it (or you were to sell it once its yours), it would also be a criminal copyright infringement, as well as possibly a trademark infringement. Both have very nasty implications.
