How do bloggers follow copyright law for images?
|
How do bloggers avoid copyright infringement if they take a republished image found on albums such as Pinterest? How can they give credit where it's due? How can they follow copyright law?
All Answers To QuestionsAnswer 1
You cannot legally use a republished image found on an album. It belongs to whoever created the image for the album. If you wanted to use it, you would need to go directly to the source, probably by first contact the bands manager, and then they would direct you to whoever handles imaging. Then you ask permission. If they say no, you do not use it. Answer 2
technically, they don't
giving attribution is important for plagiarism which has to do with school honor codes. If you use a scholars work, you have to cite your source. If you don't, you break the honor code and could get expelled.
When you use a copyrightable work in this setting, it is usually fair use because the transformative use is for educational and academic purposes not for a profit.
Bloggers are different because they are not in school. If they fail to give attribution, it isn't a breach of any blogger honor code. Because blogs are usually commercial in nature (they get ad revenue), most uses of copyright material are not fair. It's going to depend.
One thing bloggers usually don't realize is that identifying the author of the work can often draw their attention to the copyright infringement. Also making some sort of statement that seems to indicate that the person knows that there might be copyright infringement. e.g. no copyright violations intended, then the innocent infringer defense won't be available.
A blogger can follow copyright law by only using copyrighted work for criticism, satire, reviews, academics, discussion etc. and only copying limited amount. A photograph for instance with low resolution has a greater fair use argument. The criticism for a photo would have to be over the photographers choice of angle lighting etc., not the subject matter, however. Answer 3
