I took portraits of people and stamped my name with a copyright logo. My photos R in their brochures, website?

I have taking portraits of people and sold them with my name and a copyright logo on the front and back of the print. Now I see my portraits, I took are in their brochures and on their websites. Is there any thing I can do about them using my copyright pictures without my permission.

If you did not get a release form signed by them stating that you owned the rights to their image, it is of public domain and they can do what they please with them. Copyrighting is not simply just putting a watermark on a photo. http://www.copyright.gov/

Did you have their permission to sell their likeness? I am not sure they are the infringers here.

Did you actually copyright the images or just put a copyright logo on them? If you're registered the copyright and trademark for the images, then you can have a lawyer send the website a "cease and desist" notification, which is a legal document ordering the site operators remove the copyrighted material or legal action will be taken. If you've not actually registered the copyright, then you'll need to speak directly to the site operate, via email perhaps, and ask them to remove it. If they refuse, you may want to seek legal advise as it gets a bit more complicated. Good luck.

If you are the photographer then you (or your employer) are the "author" and the legal owner of the copyright. If you sell copies of your works the people who buy them are not permitted to make further copies, publications or distributions without your permission. If they use your works for profit, knowing that you own the copyright, then they can also be charged with criminal copyright (a felony in the USA). You do not need to register anything to "own" your copyright - it is automatic and instantaneous. However, you obtain powerful leverage if you register your copyright in the USA. It is very inexpensive and you can copyright a "portfolio" for a single fee then sue for infringement for any part of it. Notify the website owner that your copyright works are being used on their website without your permission and demand that they be removed immediately. If they do not comply, file criminal charges with the FBI and have an attorney file a civil lawsuit for damage (including statutory damages if they continue to use the works after you register the copyright).
