Video on youtube copyright infringement or fair use?

Would putting a Guinness beer poster or any other poster on the wall in a video on youtube be considered copyright infringement? Or am I protected under the fair use policy? If I became a youtube partner, I would be making money off the video. But I wouldn't be taking any money away from Guinness. I wouldn't be making any money at Guinness's expense.

Just to make sure, as long as the video doesn't NEED the poster, just take it off the wall for the time being. You could always personally ask Guinness for permission, but it might take a while to get a reply.

No it wouldn't. as long as you say in the description that Guiness doesn't belog to u.u will be ok!

Having a piece of copyright art in the background of another image, generally is not considered a copyright violation. If it is the focus of your new image, that is different. Giving credits, or weather or making no money generally does not excuse you from copyright infringement as some have indicated. Some images either do not have copyright protection or can be used under fair use. There may also be license to use them under some conditons, but for the most part, copying someone elses work is copyright infringement. Having an image in the background is generally no considered copying.
