I am a small business owner and I recently did a design for shirts for a foundation. I have now found that they have posted my design on the internet without my consent. Is that considered copyright infringement?

it seems to me that if you did it for them that it is theirs. since it was for shirts, it was clearly for public display. unless you had some limited licensing contract with them , i dont see how you have been damaged.

Under the copyright law, although the general rule is that the person who creates the work is its author, there is an exception to that principle; the exception is a work made for hire, which is a work prepared by an employee within the scope of his or her employment; or a work specially ordered or commissioned in certain specified circumstances. When a work qualifies as a work made for hire, the employer, or commissioning party, is considered to be the author. But if you designed that shirt on your own and they copied it, there is copyright infringment.
