What are the copyright rules for photographic images of commercial structures, like Disneyland?

I have very old images (home movies and stills) from inside and outside of Disneyland. Would I be infringing on any Disney copyright or image rights if I were to sell copies of these images?

No. These are your personal property. As long as you don't try to sell them as being made by Disney, you can do whatever you want. Answer 2
Your best bet is to actually call and ask. Go to a website and start looking for contact info. It could take a while to get to their legal dept. Although you took the photo, the laws regarding copyright are horribly complicated. It depends on what you are doing with the picture as a finished product. The Disney company is one that legally pursues every instance of infringement they hear about. This is not an area to make a mistake, it could be very costly. Answer 3
Yes, actually, you do need a property release to be able to sell these images. I don't know all the details (try a search for property release laws), but I know that you do need one to prevent legal action against you. Answer 4
You definitely need to check with Disney's legal department, particularly since The Mouse is big on lawsuits. You don't necessarily have the right to sell or publish photos of public structures just because you were the photographer. Answer 5
I would suggest contcting a lawyer for legal advice. In general, you can't use photos of buildings (or people) for commercial purposes without a release from the owner or the person. I would suspect Disney has a whole team of lawyers waiting to enforce these rules. << GO BACK to questions
