well I'm doing a project for school and i want to know if the copyright act of 1976 section 107 "fair use" will let me use more than 30 seconds of a song.
All Answers To QuestionsAnswer 1
No, there is no standard of what is fair use and what is not. It all depends on the judge, but a good rule of thumb is that any clip of audio that has more than 4 consecutive sounds in it, is infringing on copyright. Like 4 drum beats, all in a row that are exactly the same, or if Christina Aguilera says "You are beautiful, words cant bring you down"...you are beautiful is only 3 consecutive lyrics, but you are going into bad territory once you make it four and say "you are beautiful words". 30 seconds of a sound clip is definately copyright infringement.
Perfect example, Vanilla Ice's "Ice Ice Baby" used a bass line that was 7 consecutive sounds in a row, which he got from Queen's "Under Pressure", so he was sued for that. It was way less than 30 seconds and he still lost that lawsuit. << GO BACK to questions
