what happens if someone replicates my copyright design?

i created a design and copyrighted it. however, i found out someone replicated my design and is putting it on t-shirts. what actions can i take? can i sue them? @justgetitright i failed a copyright protection with the government. they came upon my design when i sent them a picture example of the design on the shirt to sell to their store. they said they would review it and get back to me. they never got back to me and i found out they were making shirts with my design. however, when i sent the images, it did not have any watermark or anything saying it was copyright

Did yo actually file for copyright protection with the government? If not then it would be hard for you to prove that you owned the design. I am curious as to how the other person came upon your design? was it something that you sold to them and if so was the copyright notice clearly displayed or a written notice given ? Your best bet would be to contact a patent attorney and get his opinion
